Running tires with different tread depths

Anyone here on WSC have an opinion on this? 

I picked up a set of wheels and tires for the Legacy, and like an idiot I bought them in the dark without measuring tread depth.  2 of them are 9/32nds tread, and the others are 6/32nds with a bit less on the shoulders.  Is that too far out of spec for the AWD system?

The tires are otherwise the same make and model and are all about a year old.

Subaru recommends no more than 2/32 of tread depth between tires. I was in a similar situation with my winters (1 winter was damaged and the remaining had 8-9/32 remaining) and I had to buy another set.
